Terms and Conditions of Use for the The wholey water project
These Terms and Conditions (“Terms”) govern your access to and use of the Tap-Map App provided by The Wholey Water Project (TWWP). By downloading, accessing, or using the Tap-Map App, you confirm that you have read, understood, and agree to these Terms. If you do not agree, please discontinue your use of the App.
Access and Eligibility
- Membership Requirement: Access to the Tap-Map App is available only to members of TWWP.
- Subscription Requirement: Access to the map feature within the App is limited to active subscribers.
- Account Registration: You must create an account with verified identity or email to use the App. All information provided must be accurate and kept up to date.
Subscription Management
- In-App Subscription Handling: Subscriptions, renewals, and cancellations are managed directly through the App. Users will receive automated reminders about upcoming payments.
- Subscription Obligations: Subscribers are responsible for ensuring their payment methods are valid and up to date. Failure to maintain a subscription will result in the loss of map access.
Roles and Permissions
- Role-Based Access: Different roles (e.g., Quenchers, Hosts, Facilitators) have different permissions within the App.
- Notifications: Users may receive notifications related to tasks, tap usage, or maintenance alerts based on their role.
- Host Permissions: Hosts can manage tap availability and approve or decline access requests through the App, ensuring smooth tap operations.
Tap Availability and Service Interruptions
- Tap Status: Tap availability is shown in real-time on the map within the App. Service disruptions will be communicated through status changes on the map.
- Service Responsibility: TWWP will make reasonable efforts to maintain uninterrupted service but is not liable for disruptions beyond its control.
- User Expectations: Members are expected to check the App for updates on tap availability before planning their usage.
Water Quality Monitoring
- Automatic Data Collection: Water quality data is collected automatically via monitoring tools integrated with the tap system.
- Manual Data Input: In the event of WiFi failure, members will be required to input water quality data manually through the App.
- Data Accuracy: Members are responsible for ensuring manual inputs are accurate to maintain service integrity.
User Responsibilities and Conduct
- Compliance with Guidelines: Users must follow these Terms and any instructions provided by TWWP or Hosts.
- Misuse and Abuse: Misuse of the App, abusive behavior toward Hosts or other members, or exceeding agreed-upon water usage limits will result in a warning, suspension, or termination of access.
- Security and Account Protection: Users must keep their login credentials secure and notify TWWP immediately if they suspect unauthorized access to their account.
Data Collection and Privacy
- Location Tracking: The App may collect location data to show nearby taps. Users must opt in to location tracking, and can adjust their settings at any time.
- Role-Based Data Access: Access to certain data (e.g., user profiles, water quality reports) is restricted based on user roles.
- Privacy Policy: All personal data will be collected, stored, and processed in accordance with TWWP’s Privacy Policy.
Intellectual Property
- Ownership: The Tap-Map App, including all content, design, and code, is the intellectual property of TWWP or its licensors.
- Permitted Use: Users may not copy, modify, distribute, or reverse-engineer the App or any part of its content.
- Feedback: Any suggestions or feedback provided to TWWP become the property of TWWP, with no compensation owed.
Dispute Resolution
- In-House Resolution: All disputes related to the App or its use will be resolved through TWWP’s internal dispute resolution process.
- Binding Decision: By using the App, users agree to abide by the decisions made through this process.
- Court Exclusion: TWWP prefers internal resolution and aims to remain independent of government legal systems.
Liability and Disclaimers
- Service Disclaimer: While TWWP makes reasonable efforts to maintain the accuracy and availability of tap data, the App is provided “as is” without guarantees.
- Limitation of Liability: TWWP is not responsible for any direct, indirect, or consequential damages arising from the use of the App or the services provided through it.
- User Responsibility: Users are responsible for their own due diligence regarding tap status and water quality.
Termination of Access
- By User: Members can delete their account or cancel subscriptions through the App at any time.
- By TWWP: TWWP reserves the right to suspend or terminate access for violations of these Terms or misuse of the App.
- Effect of Termination: Upon termination, users lose access to the App and any associated features, including the map.
Modifications to Terms
TWWP reserves the right to modify these Terms at any time. Users will be notified of significant changes through the App or email. Continued use of the App indicates acceptance of the updated Terms.
Governing Law
These Terms and Conditions are governed by the laws of New Zealand. Any disputes not resolved through TWWP’s internal process will be subject to the jurisdiction of New Zealand courts, if required.
